A Family-Focused Approach to Justice

Ernie runs Tosh Law Firm alongside his son, Ben. Together, they maintain a very small caseload so they can personally know the families they represent and fully focus on serious nursing home cases. Ernie believes families deserve real answers, accountability, and the peace of knowing what happened to their loved one was not ignored or swept under the rug.

From Prosecutor to Nursing Home Trial Attorney

Ernie originally thought he would become a corporate attorney. That changed when he started working as a prosecutor for the Tarrant County District Attorney’s Office in 1990. Prosecuting crimes showed him what it meant to fight for innocent people who had been seriously harmed and needed somebody willing to stand up for them.

Years later, Ernie was asked to help with a nursing home case. He realized these cases felt a lot like criminal prosecution. There was an innocent victim, a family looking for answers, and a system trying to avoid accountability. That work became the focus of his career.

Why Nursing Home Abuse Cases Are Different

Ernie does not view nursing home cases as simple medical malpractice claims. In many situations, the real problem starts long before the injury happens. Corporate decisions involving staffing cuts, budgets, training failures, and profit-driven policies often create the conditions that lead to neglect, abuse, pressure injuries, dehydration, choking incidents, and wrongful death.

That is why Ernie spends so much time digging into financial records, staffing data, internal policies, and corporate structures. He has become nationally recognized for uncovering how nursing home corporations operate and where the real evidence is buried.

Nationally Recognized Experience and Expertise

Ernie limits his practice entirely to nursing home abuse and neglect litigation. He has tried over 150 jury trials to verdict and has recovered millions of dollars for families seriously harmed by nursing homes. He has also become a nationally recognized expert in nursing home finances, staffing, and organizational structures.

Ernie has consulted on thousands of nursing home cases across the country, testified before Congress, published peer-reviewed articles on understaffing, and worked with state attorney general offices on nursing home fraud investigations. He regularly teaches attorneys, advocacy groups, ombudsmen organizations, and Medicaid fraud units nationwide.
