From Engineering to Nursing Home Litigation

Ben Tosh did not start out planning to become a lawyer. He graduated from Texas Tech University with a degree in chemical engineering and originally expected to work in that field. But the more he watched the work his father, Ernie Tosh, was doing in nursing home litigation, the more he realized he wanted a career built around helping people and pushing for change. That decision led him to South Texas College of Law in Houston, where he attended the school’s part-time program while working at the same time.

He graduated cum laude and entered a field that quickly became personal to him. Ben approaches nursing home litigation with the mindset of a prosecutor. In his view, many of these cases are not simple accidents. They are the result of corporate decisions that put profits ahead of vulnerable people. Understaffing, ignored safety concerns, altered records, and false charting are problems he sees over and over again.

Early Experiences That Shaped Him

One experience before law school helped solidify Ben’s decision to become an attorney. During a summer class at a community college, a professor accidentally left a microphone on while making racist, sexist, and ageist remarks about students in the hallway. The class was stunned. Many students wanted to report the incident but were worried about retaliation.

Ben volunteered to represent the class. He gathered recordings, prepared notes, met with the dean, and advocated for the professor’s removal. The school reassigned the class to a new professor and disciplined the instructor involved. More importantly, the experience showed him how meaningful it could be to stand up for people who felt powerless in a difficult situation.

Focused on Serious Nursing Home Cases

Ben primarily handles wrongful death, bed sores, and fall cases involving nursing homes and assisted living facilities. He and Ernie intentionally keep a small caseload so they can spend substantial time investigating each matter, analyzing records, consulting experts, and preparing cases for litigation and trial. That allows Tosh Law Firm to go deeper into the facts than many high-volume firms are able to.

A Personal Understanding of Trauma

Ben’s connection to medical negligence is also personal. When he was in fifth grade, his father nearly died after a negligent surgical procedure. Ben still remembers sitting in the hospital with his younger brother while his mother spoke with doctors and staff, unsure whether Ernie would survive.
